Citizenship and Immigration Canada Amends Temporary Foreign Worker Regulations
On April 1, 2011, amendments to the Immigration and Refugee Protection Regulations came into affect.
The amendments include the following:
1. R 200(5) has been amended to include specific factors for assessing the genuineness of an employer's offer of employment.
2. R 203(1)(d) has been amended to include specific employer related requirements for Live-In Caregivers.
3. R 200(1)(c)(ii.1)(B) and R 203 (1)(e) have been added to make employers ineligible to apply for a LMO if they have failed to substantially meet the terms of a previous offer of employment under an LMO within the previous two years.
4. R 200(3)(g) allows Citizenship and Immigration Canada to publish a list of employers who have become ineligible to apply for a LMO under R 200(1)(c)(ii.1)(B) and R 203 (1)(e).
5. R 200(3) (g) has been amended to provide for a cumulative four year cap on a Temporary Foreign Worker's period of employment.
6. R 203(3.1) has been added to require all LMOs to indicate a period of validity.
